Fees & Disbursements (Trial Implementation)

I. Cases of First Instance
    1. Criminal Case:
    ① Cases in Beijing: For the phase of investigation and appeal (including investigation by the procuratorate), professional fee RMB 12,000 yuan, operation charge 2,000 yuan (including cost related to inter-city transportation, communication, photocopy, typing, printing, meal delay, etc.);for the trial phase, professional fee 12,000 yuan, operation charge 2,000 yuan (including cost related to inter-city transportation, communication, photocopy, typing, printing, meal delay, etc.). If travel outside Beijing is required, travel expenses are to be reimbursed by the client on a cost incurred basis.
    If the two phases are combined in representation, professional fee 20,000 yuan, operation charge 4,000 yuan (including cost related to inter-city transportation, communication, photocopy, typing, printing, meal delay, etc.).
    ②Cases outside Beijing: For the phase of investigation and appeal (including investigation by the procuratorate), professional fee 25,000 yuan;for the trial phase, professional fee 25,000 yuan. Additional operation charge 1,000 yuan per lawyer will be billed. Travel expenses are to be reimbursed by the client on a cost incurred basis.
    If the two phases are combined in representation, professional fee 40,000 yuan. Additional operation charge 2,000 yuan per lawyer will be billed. Travel expenses are to be reimbursed by the client on a cost incurred basis.
    ③ Other operation expenses (including cost for translation, searches, appraisal, notarization and other expenses paid by the lawyer on behalf of the client) are to be reimbursed by the client on a cost incurred basis.
    ④ For criminal cases related to national security, criminal gang, drug trafficking and other kinds of difficult cases, professional fee will be charged at no less than twice the rate as described above; the rate for other operation charges is the same as described above.
    2. Civil, Economic and Administrative Cases
    ① Professional Fee：
    (a) For ordinary civil or economic case in Beijing with no property subject involved, professional fee 5,000—20,000 yuan;for case of Intellectual property and real estate dispute with subject hard to define, professional fee 10,000—20,000 yuan;for ordinary administrative case in Beijing with no property subject involved or for ordinary civil or economic cases outside Beijing, professional fee no less than 20,000 yuan; for administrative case in Beijing concerning revocation of permit or business license with no property subject involved, professional fee no less than 30,000 yuan;for administrative case outside Beijing with no property subject involved, professional fee no less than 30,000 yuan;for administrative case outside Beijing concerning revocation of permit or business license with no property subject involved, professional fee no less than 50,000 yuan.
    (b) For civil, economic or administrative case in Beijing with property subject involved, professional fee will be charged on the basis of subject by the rate as stipulated in the following table:

② Case-handling operation charge：
    (A) Operation expenses involved in case handling, including cost related to inter-city transportation, communication, photocopy, typing, printing, meal delay, etc., will be charged by the following rate:
    a. RMB 1500 yuan for case in Beijing urban areas (the 8 urban districts) (travel expenses are to be reimbursed by the client if travel outside Beijing is required);
    b. 2,000 yuan for case in Beijing suburban areas (travel expenses are to be reimbursed by the client if travel outside Beijing is required);
    c. For case outside Beijing: travel expenses are to be reimbursed by the client on a cost incurred basis; additional operation charge of 1,000 yuan per lawyer will be billed.
    (B) Other operation expenses (including cost for translation, searches, appraisal, notarization and other expenses paid by the lawyer on behalf of the client) are to be reimbursed by the client on a cost incurred basis.
    3. For serious, complicated or difficult cases, professional fee will be charged at no less than twice the rate as described above; the rate for other charges is the same as described above.
    II. Cases of Second Instance
    1、If the case of first instance was not represented by this Firm, professional fee will be charged at the same rate as for case of first instance described above; the rate for other charges is the same as described above.
    2、If the case of first instance was represented by this Firm, professional fee will be charged at half the rate as for case of first instance described above; the rate for other charges is the same as described above.
    3、If the case of second instance is remanded for a new trial, professional fee will be charged at half the rate as for case of second instance; the rate for other charges is the same as described above.
    III. Retrial (Appeal) Cases
    Professional fee will be charged as follows, the rate for other charges is the same as the first instance.
    1.At the moment of signing the agreement of agency, 20000 yuan will be charged;
    2. The Court decide to receive and register the case, further 50000 yuan will be charged;
    3.The Court judge to retrial, the rate will be charged as the first instance.
    IV. Cases of Enforcement
    1. If the case of first instance or second instance was not represented by this Firm, professional fee will be charged at the rate as for case of first instance; the rate for other charges is the same as described above.
    2. If the case of first instance or second instance was represented by this Firm, professional fee will be charged at half the rate as for case of first instance or second case; the rate for other charges is the same as described above.
    V. Nonlitigious Legal Matters
    1.Due Diligence, Legal Counsel, Legal Opinions, Lawyer Witnessing
    ① For drafting, reviewing and amending contracts or articles of association, the charge will be based on the amount of the subject, but no less than 5,000 yuan per time; If there is not contract subject, each document will be charged no less than 5,000 yuan.

② For providing legal opinion, counseling recommendation, participation in project negotiation, due diligence, lawyer witnessing, the charge will be based on the amount of the property subject involved, but no less than 20,000 yuan; if there is not property subject, each piece will be charged no less than 20,000 yuan

 ③ By mutual consultation, professional fee may be based on hourly rate at 1,000 yuan/hour.
    2. Company’s Establishment
    Professional fee is based on the amount of the registered capital at the following rate ——

    Professional fee will be based on the amount involved at the following rate:

    Professional fee will be charged at one fourth of the rate as for enterprise reorganization:

6. Real Estate Legal Counse
    Professional fee will be charged at 5‰--8‰of the total investment amount involved.
    7. Perennial Legal Counsel
    Professional fee will be charged at no less than 100,000 yuan per year for acting as perennial legal counsel for state agencies, enterprises or institution,  through consultation and based on the size of the organization; professional fee will be charged at half of this rate when representing cases of litigation, arbitration and serious nonlitigious legal matters.
    8.Personal Attorney
    10000 yuan per year.
    9. Other expenses involved in the above nonlitigious legal services (including cost for transportation, communication, photocopy, typing, printing, translation, searches, appraisal, notarization and other expenses paid by the lawyer on behalf of the client) are to be reimbursed by the client on a cost incurred basis.
    VI. Legal Counseling
    100 yuan per hour; minimum an hour.
    VII. Preparation of Legal Documentation
    500—800 yuan per document.
    VIII. Foreign-related or Hong Kong, Macao, Taiwan Related Cases
    No less than twice the rate as described above
